#2 the gema cannot ban anything by itself. They just tell youtube what have to be blocked in the countries where the gema is.

Basicly youtube just uses their player to disable the video in these countryies. So if you would know the absolute path of the .flv file, you could access it easily.
(As far as I know, youtube hides them outside the webserver so you cannot access them without the player)

If there is nobody who bans the .swf files (here for example), the gema cannot do anything without a interlocutory injunction.

Default: Youtube for the Quality
Backup: The original swf
Still missing: The switch to view the swf per request.
